Art. 0.2Lessee: the person who uses goods, vehicles or services from E-adventure .  
Art. 0.3Group: group of people including the lessee, who together use goods, vehicles or services from E-adventure.  
Art. 0.4Driver: anyone who drives a vehicle.    
General
Art. 1.1The lessee is liable for the other persons in his group. He is therefore responsible for conveying the rental conditions to them.
Art. 1.2The use of the goods and vehicles entrusted to the lessee, is entirely at the risk of the lessee.  
Art. 1.3The lessee is responsible for the proper use of the protective equipment entrusted to him-such as helmets-as well as those of the other persons in his group.  
Art. 1.4The lessee is not permitted to assign goods or vehicles to third parties for use or sublet.  
Art. 1.5The lessee is expected to treat the goods and vehicles entrusted to him responsibly and with due diligence and to use them in accordance with their intended purpose. The lessor has at all times the right to reclaim goods and/or vehicles in case of doubt about this, without any right to compensation to the lessee.  
Art. 1.6The lessee is expected to return the goods and vehicles in the same condition in which he received them.  
Art. 1.7The goods and vehicles used by the lessee must be returned by him at the location where they were received, unless otherwise agreed upon with the lessor.  
Art. 1.8The routes with the e-scooters are laid out in such a way that they can be easily completed within the following durations, taking into account breaks along the way:
- Discovery tour, during the day: 3h
- Outdoor Escape Game: 3h
- Experience tour: 10h
- The Meuse at dusk: 4h
- Romantic evening: 4h
If the above times are exceeded, all direct and indirect costs will be for the hirer, including possible loss of rent. These durations start from the hour chosen in the reservation request.
Art 1.9The e-scooters are always sufficiently charged to ride out the chosen experience tour without any worries. The signposted tours must be strictly followed at all times. It is forbidden to deviate from the plotted route. If the battery runs out of power due to deviating from the plotted route, pick-up costs and loss of rental will be charged to the lessee.  
Art. 1.10During the duration of the rental, footage may be taken by the lessor. This footage may be used and shared in any way (social media,...). If you do not wish to give permission for this, please report this on site when signing the rental contract.
Art 1.11In case of dispute, only the courts of the judicial district in which the registered office is located have jurisdiction and Belgian law is always applicable.
Safety
Art. 2.1Each driver of an e-scooter must hold a valid car license (B) or scooter license (AM or A3). If this is not the case, the deposit will be increased (see Art. 4.1).
Drivers without driving license B/AM/A3 are prohibited from entering the Netherlands.
Each driver must present his driving license, in combination with identity card or passport, at the latest before the start of the activity. The lessor has the right to take a (digital) copy of these documents. If one of these documents cannot be presented, the lessor has the right to refuse the right to drive to the driver(s) concerned, without any compensation.
Art. 2.2The minimum age of drivers is 16. Is there anyone between 16 and 21 years old in the group? Then for every person between the ages of 16 and 21, at least one companion aged 21 or older must be continuously present.  
Art. 2.3Driving vehicles is permitted only when sober. Therefore, driving under the influence of alcohol, drugs and/or medications that may affect driving skills is prohibited. If there are doubts about this, the lessor has the right to refuse the right to drive without any compensation.  
Art. 2.4The driver should adapt his speed to local conditions. In doing so, he is expected to take into account other road users, stray animals, children, slipperiness, weather conditions, crowds, etc.  
Art. 2.5The driver must at all times comply with the traffic regulations in force in the country where he is driving. The driver is expected to know these. A non-exhaustive summary is attached to this agreement for your information. Traffic violations and resulting costs are the responsibility of the renter.  
Art. 2.6Passengers can ride along if the driver is at least 18 years old.
Children can ride on the e-scooter as passengers from the age of 8 years, provided that their height allows them to sit stably.  
Art. 2.7It is forbidden to take pets on the e-scooters, except in specially designed and closed baskets, provided that they are properly attached to the specific carrier of the e-scooter.  
Art. 2.8Because of the electric drive, others do not hear the e-scooters coming. You also approaches faster than expected. Therefore, the driver is required to leave the simulation sound on the e-scooter on at all times.  
Art. 2.9Instructions from the lessor must always be strictly followed by the lessee and his group.
Damage and theft
Art. 3.1Any damage, in any form, is entirely the responsibility of the lessee, whether due to the fault of the lessee or third parties. The lessor is not liable for any form of damage, incurred during the use of the goods and vehicles entrusted to the lessee, in use or idle. This applies to damage to the lessee as well as to third parties, goods, etc. In case of damage, the lessor must be informed by the lessee at all times, at the latest when the goods or vehicles entrusted to him are returned. The lessee will reimburse the lessor for the cost of repair as well as the cost of replacement and loss of rent. In case of non-payment of these costs, not only these costs but also all other costs will be borne by the lessee.  
Art. 3.2The lessee is fully liable for theft or loss of the goods or vehicles entrusted to him. In the event of theft or loss, the lessee must notify the lessor immediately. The lessee will reimburse the lessor for the cost of replacing stolen and missing goods and vehicles, including the loss of rent thereof. Failure to pay these costs will result in not only these costs but also all other costs being borne by the lessee.  
Art. 3.3E-scooters must be parked in the steering lock at all times and be continuously visible to the lessee. Keys should be securely stored away.  
Art. 3.4The e-scooters are insured for damage to third parties (civil liability). The deposit for this is €250. If damage to third parties occurs, this amount of €250 will be borne by the renter. In the following cases, this amount to be borne by the hirer is increased to €750:
- drivers under 21 years of age
- drivers without driving license B/AM/A3
Payment terms and deposit
Art. 4.1Before starting to use goods and vehicles, the renter must have paid the total amount of the agreement -including deposit. Otherwise, these goods and vehicles will not be entrusted to him. For e-scooters, a deposit of:
- €250 up to and including 6 scooters per reservation.
- €500 if more than 6 scooters per reservation.
- €500 if a driver under 21 years of age OR a driver without driving license B/AM/A3 is in the company.
If the deposit is paid by bank card, it will be refunded to the renter by the rental company via bank account within 7 working days after the use of the goods and vehicles entrusted to the renter, provided that no theft, loss or damage of any kind has been detected. If theft, loss or damage is detected, the deposit will be retained until all expenses are covered. In case of theft, loss or damage, the lessor will provide the lessee with a binding price estimate. If the costs exceed the amount of the deposit paid by the tenant, the tenant must transfer the difference to the landlord by bank transfer within 14 days of receiving the estimate.  
Cancellations and refunds
Art. 5.1Cancellations by the tenant: up to 7 days before the reserved time is free of charge. For cancellations between 3 and 7 days before the reserved time, the landlord will refund 50% of the cancellation fee to the tenant. If the cancellation takes place later than 3 days before the reserved time, the lessee is not entitled to any financial compensation.
Cancellations due to bad weather conditions are made by mutual agreement between lessee and lessor. In case of cancellation due to bad weather conditions, the renter has the right to rebook his activity free of charge, within 12 months.  
Art. 5.2Cancellations by the lessor: if the lessor makes a cancellation -for any reason- he will refund the amount paid by the lessee in full to him via bank account, within 7 working days after cancellation.  
Art. 5.3If the group does not show up or shows up incomplete at the reserved time, the lessee is not entitled to financial compensation.
